But i dont see why this is fair because he broke our contract and now he is getting repaid for it so basically there is no consequence

There is nothing in the contract as to who will take possession of the sword if or when a user breaks part of the contract, since it is an item you both purchased together the only fair way I see is if the user who is not receiving the sword will be reimbursed with the monetary values of what they out into obtaining the item or else they are left with nothing which it totally unfair. This is the only fair for both users outcome I can foresee.

 

But the contract states the\at if a user breaks the contract he will be banned

 

I will continue to do so if necessary, if it is required you may tag me back here or add me to the conversation when you have come to a conclusion. I suggest you try to work out this situation with a new contract if you do not wish to either take possession of the sword and pay half its value to sick24 or accept payment for half its value. the sword will remain in my possession till this situation has been resolved. The sword is in a locked chest in my town and will not move until a conclusion to this matter has been met. Please contact me when a conclusion has been found.

I logged once with the sword because my comp died thats not really considered breaking the contract.
