All users listed must sign.> General Purpose of Contract: safe sale of eff7 pick on payment plan <general outline of what the contract is for.> I (the contract initiator) agree to the following terms, and agree that my failure to complete such terms will result in a breach of contract, as outlined in Rule 3: i @scgenesis agree to add @Torzon to a chest located at x: -12776 y: 63 z: 377 with /cmodify torzon that contains my eff7 pick with unique id #I9CZRW4C no later than 12:00 pm (mid night) 11/13/15 (friday) after i @scgenesis recieve $170k plus 350 nstars from @Torzon @scgenesis agrees that after the 3 week payment plan has been succesfully completed (or the 900k from the plan has been payed early), resulting in @scgenesis recieving $900k ecd ontop of the nether stars plus $170k upfront plus late fees if applicable, @scgenesis will transfer full ownership of the eff7 to @Torzon at which point the agreement will be fulfilled. <list here terms that you will uphold in this contract.> The other user(s) involved with this contract must agree to the following terms: @Torzon agrees to pay @scgenesis $170k as well as 350 nstars no later than 11/13/15 12:00 pm (mid night) est and before he gets access to the chest with the eff7. @Torzon agrees to use @scgenesis eff7 pick with unique id #I9CZRW4C located at the above coordinates to pay @scgenesis $300k ecd every week for 3 consecutive weeks starting from the date he gets access to the chest containing the eff7 (no later than 11/13/15). This will total 1.07million ecd total plus 350 nstars. @Torzon agrees that if any one of the 3 weekly payments is not fulfilled in whole, @scgenesis will have the option to either reclaim the eff7 with out giving a refund of previous payments, or add $115k ecd to the total amount owed. If the second option is chosen by @scgenesis late fees of $115k per week will be added ever week @Torzon is behind on his payments (weekly payments plus late fees) for the durration of the 3 week payment plan. If the eff7 is lost, broken, stolen ect, @Torzon must inform @scgenesis right away. At this time @scgenesis will be given 2 options: either require @Torzon to to pay @scgenesis $2.2million ecd payed back with minimum of $150k/week payments, or request that @Torzon provide @scgenesis with a new eff7 with in 4 weeks of a complaint being filed. @Torzon agrees to put the pick back in the chest at the coordinates stated above when ever he goes offline, goes afk, or for some reason is not using the pick actively. @Torzon agrees that @scgenesis may request to see the pick at any time or any reason to be sure he has it and it hasnt been broken/lost. @Torzon agrees that if @scgenesis suspects at any time something fishy is going on, @scgenesis may rrequest the pick to be returned to him at any time through out the 3 week payment period with the condition @scgenesis return any payments @Torzon has made plus his 350 nether stars and $170k upfron . If at the end of the 3 week payment plan @Torzon has not completed all payments (weekly payments plus late fees) @scgenesis will be given the option to either reclaim the pick with no refund, or add $115k to the total amount owed to @scgenesis. If the second option is chosen by @scgenesis @Torzon will be given 1 additional week to pay the remainder of the total amount due to @scgenesis (weekly payments plus late fees). @scgenesis may agree to give 3 additional weeks of time to repay the total debt, each week adding an additional $115k to the total debt. @scgenesis may file a complaint if any of the above terms of the contract are not fulfilled, which will result in the penaltys outlined obove in the options given to @scgenesis. Any clauses in the contract that give @scgenesis an option for penalties, will be chosen by @scgenesis at his sole descretion and inforced. If a clause is broken that doesnt give @scgenesis an option, the stated consequence will be applyed. If no consequence is stated, but a clause of the contract has been clearly broken, @scgenesis may request the pick back as a fail safe with no refund. If @Torzon refuses a request that the pick be returned, $250k will be added onto his total debt, and he will be banned. <list here terms that the other parties will be agreeing to by signing tainhis contract.> I agree that the terms in this contract are subject to all of EcoCityCraft's rules, including the rules listed specifically in this forum. I understand that the contract may be affected by future changes in EcoCityCraft rules and server updates, and I accept that due to the possibility of such changes, this contract may be at my own risk. I understand that the contents of this contract are subject to staff assessment, review and approval before it is a binding contract under EcoCityCraft rules. There are quite a number of issues which prevent this contract from being able to be approved. Firstly, the contract violates the very concept of contracts on a few fronts. - A contract cannot state that a user will be banned, as players cannot make that action. - In a few instances this contract outlines what will happen after a complaint has been filed. This is an improper use of complaints, because if the scenario has happened, the contract has not been breached and no rules have been broken UNLESS the following clause is not fulfilled. Secondly, the contract is very hard to read. - Bullet points are your friend. Clearer contracts help everyone. As well though, my real issue with this: This contract seems very predatory. Contracts are meant to enforce a deal on 2 sides, however this contract more or less boils down to @scgenesis being able to do whatever he wants regarding the deal. This renders the contract unenforceable. If you want to write in a penalty you are more than free to, but you must clearly define what it is. You may not say that it can be chosen when the situation arises out of a list. As well certain clauses do not clearly terminate after payments have been completed - leaving the possibility for abuse.
