Answer: Yes. I have checked/used both the Region Info command and there are no players that possess a town by this name in both legacy and rising worlds. I have used a Flint to check all blocks within the proposed zones and it is vacant.

No, you will not waiting for any neighbouring mayor responses, as my current town is the only nearest town. It is marginally more than 15 blocks away from it.
