People rarely ever think of the consequences when intentionally deciding to break the rules/law - This applies to both IRL and Ingame. All this will do is hurt the players who intentionally intend to payback and get banned by accident such as IRL issues - There's no way to tell if a player is intending to harm other users when scamming, and all this will just do is hurt both players who actually intend to pay back their debts and some loaners are some players won't appeal due to large burden they have.
No, it is very different. People who intend to scam want to cause harm, and should be treated differently than people who don't intend to scam and have IRL issues that have been keeping them from paying the loan. Malicious users should be treated very differently from users who mean no harm. You're acting like everybody has tons of time to devote to ECC and there's absolutely no circumstances that should prevent them for paying, which is totally not true. A black-and-white policy toward scammers is not realistic nor is it well thought, at all.
You are able to charge late fees for players missing payments - If you wish to do so, include that in the agreement you make with the players.

maybe I should have made it more clear, I don't care what so ever about people's reasons for not paying back a loan. It doesn't matter to me in the slightest. If you can't pay back a loan then don't take one. I'm not going to argue with you about our opinions. I understand you think people should be treated differently but it doesn't matter to me. I'm totally against something would hurt both the lender and debtor as well as treat situations on a black-and-white basis, totally unrealistic and illogical. Suggestions aren't meant for your own personal beliefs/ideologies, whatever they may be - Suggestions are for things that will benefit the server as a whole, not just to cater to your personal beliefs.-

Oh yeah, I forgot to add, you're completely free to add late fees to a loan. Late fees are enforced for the majority of cases even when a user is banned (Excluding being banned via staff error.), so feel free to add late fees when you do loans. :)

If you want extra money paid because you are paid late you are free to add reasonable, well defined late fees to an agreement.
Adding a predefined grievance payment will have no nearly no effect on preventing scamming as @knears2000 has pointed out, and may even encourage offering predatory loans to higher risk but more dedicated players for extra payout.
Unfortunately this is simply not practical.-
