I have a few towns that I own which I was planning on putting things in like portals and warps and the users are banned 1 is actually permanent banned am I screwed for getting town features

You're able to file a Town Transfer Application for $250,000 if you have a contract showing that the 'ownership' of the town has been transferred to you.
After you file that, you'll become the 'official' owner, and will be able to apply for town features. -

As far as I know, yes you are "screwed" for getting town features. Sorry!

@Joliver1998 I do have contracts stating the sale of the town to me by the original owner of 2 of the 5 towns so better than nothing I suppose

The simplest answer is to get Tycoon and use your claim on the town where the original owner is permabanned.
I am happy that you are in a position to make something of those towns as that is a great area. Also, you may wish to contact the other owners in the area as they might be willing to help with getting features, especially a portal if you are willing to work with them.-
