I have already investigated and found out that @MrStealYoGrill_ has not paid the $125,000 for this week. @MrStealYoGrill_ would you be willing to come to an agreement with @DiamondDesire ? As per the contract found here: https://www.ecocitycraft.com/forum/threads/eff7-sale-to-mrstealyogrill_.143053/ you are technically obligated to make these payments. However @DiamondDesire has stated that she would be willing to give you 3 days to pay the $125,000, and as you have given the pickaxe back she is willing to drop the other 8 weeks of payments. Are you willing to agree to this?

First of all, this comment is very relevant. Secondly, smh DD... I thought you were better than this. You've profited a free 125k from this and you want more..? That's just wrong. Goes to show your true colours...

Anyway, your contract states the following:

"@MrStealYoGrill_ agrees that if he is over 1 week late with a weekly payment,@DiamondDesire has the contractual right to claim the efficiency 7 pick back without refund for prior payments."

This term states that you may take back the pickaxe at any time if the user is over 1 week late with payments. In combination with your other terms, the user at so called "fault" was screwed if they decided to abort the deal. Nowhere in the contract does it say that if at any point you decide to claim back the pickaxe that the user can stop paying fees. Therefore, if he did by chance miss a weeks payment for any reason then you could stack fees upon fees on the user if you wanted, from the contract terms stated below.
" @MrStealYoGrill_ agrees that he will pay 125k a week for the next 10 weeks until a grand total of 1.25Million plus any late fees has been paid. Everything should be paid by March 20th, 2016. If it has not been paid off by the end of this period, @DiamondDesire reserves the right to reclaim the pick without a refund."

" @MrStealYoGrill_ agrees that if he is late on any weekly payment, 10k per day will be charged for every late day for the tool."

So here we are with a user who gave you back your end of the contract(the pickaxe) and that gave you the 125k for the first week. For some reason the user thinks they will get banned so in an attempt to not get banned for 2 reasons (the last term on your contract + the unknown reason) they decided to give you back the pickaxe so they wouldn't break your contract. They completed their end of the deal so far, and they gave you more than you wanted by returning your pickaxe. That's what a kind person will do. Personally I would've legally scammed the fking hell out of you for being a *edit* and I would've "gave" your pickaxe to a friend which IS allowed, as your contract only says I can't "rent out or sell the pick". You wouldn't have been able to claim it back either since the person I gave it to has no legal obligation to give you back their new pickaxe.

Additionally you would be sh*t out of luck. The pickaxe isn't in my possession nor is it broken or lost. Sure, I am late but feel free to stack unlimited 10k's, that you won't receive, upon me. You can't claim it back since a third party who has no legal ties to this contract currently has your pickaxe. The money will not be paid and you won't be getting the pickaxe back from a third party. I didn't rent out or sell the pickaxe. Feel more than welcome to file a complaint and not get anything back. I'm not in possession of the item and therefore you can't claim it back.... Pretty sure the nullifies all of your contract terms...


I must say that you are an excellent scumbag contract creator. Sadly, you are a moderator and you should be generous and kind when making contracts. You're lucky that you got your pickaxe returned by a very generous person, and you shouldn't be asking for more than what they gave you.

Once again, smh. Hope this complaint gets denied even though I know it won't because staff are biased. Peace.

 

I wrote the contract and there is no need for getting involved in something that doesn't pertain to you. Don't jump to conclusions please. If you have a problem with it than take it up with me.

 

It doesn't sound reasonable to enforce additional payments after MrStealYoGrill_ has so kindly finished up his end of the contract by returning the pick in an attempt to mediate the situation. Especially considering the payments are for the pick he gave back.

This is an unreasonable situation. And I think Wheaton's law applies here.
Frankly I'm disappointed a moderator on ECC would stoop so low as to attempt to enforce additional payments in this situation.
